**Elihome Affiliate Program Terms and Conditions**

Welcome to Elihome's Affiliate Program. This Agreement contains the complete terms and conditions that apply to your participation as an affiliate in the Program of Elihome LLC, and the establishment of links from your affiliate website to our website, https://www.elihome.com.

** Acceptance:** 

Your participation in the Program is solely to legally advertise our website to receive a commission on products purchased by your referred individuals. By signing up for the Elihome LLC Affiliate Program, you acknowledge that you have read this agreement and agree to all its terms and conditions.

** Commissions:**

As an affiliate, you earn a percentage of the sale for each purchase made by a referred customer who has completed an online purchase with a processed valid payment. Commissions are contingent upon the following:

- All commissions are subject to verification and approval by Elihome LLC and are only paid for transactions that have been successfully completed. Transactions that result in chargebacks, returns, or refunds will not be paid out.

- Commissions will be paid monthly, provided you have met the minimum threshold of $100. If this threshold is not met, your earnings will roll over to the following month. 

- Commissionable actions are locked 35 days following the month's close, ensuring all conditions for a successful sale are met. These actions are invoiced on the 7th of the subsequent month and paid out via PayPal on the 1st of each month.

** Termination:**

We may terminate your affiliate status if you violate the terms of this Agreement or engage in any conduct that is damaging to Elihome LLC. Termination reasons may include but are not limited to:

- Advertising that is inappropriate or misleading.

- Participation in spamming or unsolicited communications.

- Content that promotes illegal activities or violates any laws.

- Failing to disclose the affiliation with Elihome LLC in accordance with Federal Trade Commission guidelines and other applicable laws.

- Engaging in self-referrals, fraudulent transactions, or suspected fraudulent activities.

Elihome LLC maintains the authority to terminate your account at our discretion and for any reason, affirming our commitment to fair and lawful affiliate practices.

** Affiliate Links:** 

Use or create approved Elihome graphics and texts for affiliate linking, maintaining appropriateness. 

** Promotions:** 

Only promote authorized deals and coupons; unauthorized use may lead to program termination.

** Liability:**

 Elihome disclaims liability for indirect loss or tracking failures.

** Term:**

 Begins with acceptance and ends upon termination by any party, with modifications notified and consented to by ongoing participation.

** Cookie Policy:** 

Credit for sales is provided for customers referred within a 60-day cookie period. 

** Governing Law:**

 This agreement is governed by the jurisdiction of Elihome's operation.

** Limitations of Liability:**

Elihome LLC will not be liable for any indirect, special, or consequential damages, or any loss of revenue, profits, or data arising in connection with this Agreement or the Affiliate Program, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement and the Affiliate Program will not exceed the total commissions paid or payable to the affiliate under this Agreement.

** Indemnification:**

You agree to indemnify, defend, and hold harmless Elihome LLC and our parent company, subsidiaries, affiliates, partners, officers, directors, employees, and agents from any and all legal claims, damages, liabilities, costs, and expenses, including legal fees and expenses, arising out of or related to your breach of this Agreement, any misuse by you of the brand name, or your unauthorized use of the provided materials or rights granted under this Agreement. You will also indemnify, defend, and hold harmless Elihome LLC from and against any claims that you have violated any law or third-party rights through any act or omission.

** Interactive Services and User Contributions**

Elihome LLC offers Interactive Services like contests, promotions, and forums for users to post various types of content ('User Contributions').This content may include, but is not limited to, text, images, photographs, audio, video, your name, likeness, and any other information or material you choose to provide (collectively, 'User Contributions'). By participating, you agree to our Content Standards and understand that your submissions may be used in Elihome’s marketing or may be displayed on our site and services. We reserve the right to change or modify our Content Standards at any time without notice.

When you provide User Contributions, you grant Elihome LLC and our partners a permanent, global, and exclusive license to use, modify, share, and build upon this content without any compensation to you. This grant includes all commercial and non-commercial uses without attribution or compensation to you.

While you retain ownership of your original content, any contribution made becomes part of a collective work that Elihome LLC has rights to use under copyright law. Your personal use content remains yours, to the extent the law allows.

** Terms of the Agreement**

The term of this Agreement begins upon your acceptance and will end when terminated by either party. We may amend the terms at our discretion; please review them regularly. Your continued use of the Service after any modifications to our Terms and Conditions will constitute your acknowledgment and your consent to abide and be bound by the updated provisions.
